We are the data controller for the personal data we collect and process as described in this Privacy Policy. This means we are responsible for deciding how and why we hold and use your personal data.

We are registered with the Information Commissioner’s Office (ICO) under registration number 00010930314.

This Privacy Policy applies to:

(a) Influencers and content creators who work with us or apply to join our talent roster;
(b) Brand and advertiser clients who engage us to manage campaigns or identify talent;
(c) Visitors to our website at https://the-cast.co.uk/; and
(d) Job applicants who apply for roles within The Cast Global Limited.

Please read this Privacy Policy carefully. We may update it from time to time and will notify you of material changes where we are able to do so.

3. THE PERSONAL DATA WE COLLECT

3.1 Influencers and Content Creators

We collect and process the following categories of personal data about influencers and content creators:

(a) Identity and contact information: full name, date of birth, postal address, email address, telephone number, and social media handles and profile links;
(b) Professional and financial information: audience demographics, engagement metrics, content categories, rates and fee information, bank account details for payment purposes, tax identification numbers, and National Insurance number (where required);
(c) Contractual information: talent agreements, campaign briefs, deliverables, brand preferences, and exclusivity arrangements;
(d) Content and image data: photographs, videos, and creative materials you share with us in connection with campaigns;
(e) Communications: records of emails, messages, and other correspondence with us; and
(f) Special category data: we may, with your explicit consent, process information about your health or disability where relevant to campaign suitability. We process special category data only where strictly necessary and with appropriate safeguards in place.

3.2 Brand and Advertiser Clients

We collect and process the following personal data about individuals at brand and advertiser clients:

(a) Identity and contact information: name, job title, business email address, and telephone number of your representatives and contacts;
(b) Commercial information: campaign briefs, contracts, invoices, and purchase orders;
(c) Payment information: billing addresses and payment details (processed securely via our payment providers); and
(d) Communications: records of your correspondence and meetings with us.

3.3 Website Visitors

When you visit our website we may collect:

(a) Technical data: IP address, browser type and version, device information, operating system, and referring URL;
(b) Usage data: pages visited, time spent on pages, links clicked, and navigation paths; and
(c) Contact form data: name, email address, and any message content you submit via a contact or enquiry form.

3.4 Job Applicants

When you apply for a role with us we collect:

(a) Identity and contact information: name, email address, telephone number, and postal address;
(b) Application materials: CV, cover letter, portfolio, work samples, and references;
(c) Interview and assessment data: notes from interviews, assessment results, and hiring decisions; and
(d) Right-to-work documentation: copies of documents confirming your entitlement to work in the United Kingdom.

4. HOW WE COLLECT YOUR PERSONAL DATA

We collect personal data from the following sources:

(a) Directly from you: when you engage with us as a talent or client, submit an enquiry, apply for a role, complete a form on our website, or correspond with us by email, telephone, or otherwise;
(b) Publicly available sources: social media platforms (such as Instagram, TikTok, YouTube, and X), publicly accessible websites, and professional directories, in connection with our talent identification and research activities;
(c) Third parties: brand partners, platforms, agents, recruitment agencies, and referees who provide information about you in the course of our work; and
(d) Automated technologies: cookies and similar tracking technologies on our website. See Section 10 for further details.

5. HOW AND WHY WE USE YOUR PERSONAL DATA

We only process your personal data where we have a lawful basis for doing so under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. The table below sets out our purposes for processing and the lawful basis we rely on in each case.

Where we rely on legitimate interests as our lawful basis, we have carried out a balancing test and are satisfied that our interests are not overridden by your rights and freedoms. You may request further information about our legitimate interests assessments by contacting us (see Section 13).

Where we rely on consent, you have the right to withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of any processing carried out prior to withdrawal.

6. SHARING YOUR PERSONAL DATA

We may share your personal data with the following categories of recipients:

(a) Brand and advertiser clients: where we are pitching or representing talent or engaging talent for campaigns, we will share relevant influencer data (such as audience demographics, contact details, and rates) with prospective or confirmed brand partners;
(b) Influencers and content creators: we may share relevant client information with talent when facilitating campaigns;
(c) Service providers and sub-processors: third-party suppliers who provide services on our behalf, including IT and hosting providers, accountancy and payroll providers, legal advisers, cloud software providers, and marketing platforms. These parties are subject to appropriate data processing agreements;
(d) Social media and campaign platforms: where required to administer campaigns (for example, boosting content or accessing creator analytics through platform APIs);
(e) Professional advisers: solicitors, accountants, auditors, and insurers, where necessary in the ordinary course of our business; and
(f) Regulatory and law enforcement authorities: where we are required to do so by law, court order, or a regulatory obligation, or where necessary to establish, exercise, or defend legal claims.

We do not sell your personal data to third parties.

7. INTERNATIONAL TRANSFERS

Some of our service providers and campaign platforms are based outside the United Kingdom. Where we transfer personal data to countries that are not subject to a UK adequacy decision, we ensure appropriate safeguards are in place, such as:

(a) the International Data Transfer Agreement (IDTA) approved by the ICO; or
(b) the ICO-approved addendum to the EU Standard Contractual Clauses.

8. DATA RETENTION

We retain personal data only for as long as is necessary for the purposes for which it was collected, or as required by law. Our key retention periods are as follows:

(a) Influencer and client records: for the duration of our relationship with you and for six (6) years thereafter, to comply with our contractual, tax, and accounting obligations;
(b) Financial and invoicing records: seven (7) years from the relevant financial year end, in accordance with HMRC requirements;
(c) Website and marketing data: for as long as your consent remains valid and active, or for up to twelve (12) months from collection if based on legitimate interests;
(d) Unsuccessful job applicant data: six (6) months from notification of the outcome of the recruitment process, unless you consent to your data being retained for a longer period for future opportunities; and
(e) Successful applicant and employee records: for the duration of employment and for six (6) years thereafter.

Where data is no longer required, it will be securely deleted or anonymised.

9. YOUR RIGHTS

Under UK GDPR and the Data Protection Act 2018, you have the following rights in relation to your personal data:

(a) Right of access: you may request a copy of the personal data we hold about you (a “subject access request”);
(b) Right to rectification: you may ask us to correct inaccurate or incomplete personal data;
(c) Right to erasure: in certain circumstances you may ask us to delete your personal data;
(d) Right to restrict processing: you may ask us to suspend or restrict our processing of your personal data in certain circumstances;
(e) Right to data portability: where we process your data on the basis of consent or contract, and the processing is automated, you may ask us to provide your data in a structured, commonly used and machine-readable format;
(f) Right to object: you may object to our processing of your personal data where we rely on legitimate interests as our lawful basis. You have an absolute right to object to processing for direct marketing purposes;
(g) Rights in relation to automated decision-making: you have the right not to be subject to a decision based solely on automated processing (including profiling) that produces legal or similarly significant effects on you; and
(h) Right to withdraw consent: where our processing is based on your consent, you may withdraw that consent at any time without affecting the lawfulness of prior processing.

To exercise any of your rights, please contact us using the details in Section 13. We will respond to all legitimate requests within one (1) month of receipt. We do not generally charge a fee for exercising your rights, although we may do so in cases of manifestly unfounded or excessive requests.
